Terms of Service

1. Acceptance of Terms

By accessing or using the Zuki mobile application ("App") and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Zuki is operated by Zuki Ltd. ("Zuki," "we," "us," or "our"). These Terms constitute a legally binding agreement between you and Zuki.

2. Description of Service

Zuki is a two-sided platform that connects:

  • Service Providers ("Providers"): Businesses and individuals offering services such as tutoring, coaching, lessons, and other activities
  • Clients: Individuals and families who book and pay for services

The Service includes mobile applications for iOS and Android, and a website at zukiapp.com.

3. Eligibility

To use the Service, you must:

  • Be at least 18 years old, or have parental/guardian consent if between 13-17 years old
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws

Parents and guardians may create accounts for minor children under their supervision.

4. Account Registration

To access certain features, you must create an account by providing accurate and complete information, including:

  • Your legal name
  • A valid phone number
  • Email address (optional but recommended)

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Submit false, misleading, or fraudulent information
  • Interfere with the proper functioning of the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any illegal or unauthorized purpose
  • Harass, abuse, or harm other users

6. Payments and Fees

For Clients

  • You agree to pay all fees for services booked through the platform
  • Payment is processed securely through our payment processor (Stripe)
  • Refund policies are set by individual Providers and displayed before booking

For Providers

  • Zuki charges a platform fee on transactions (displayed in your dashboard)
  • Payouts are processed according to the schedule in your account settings
  • You are responsible for applicable taxes on your earnings

7. Cancellation and Refunds

  • Cancellation policies are set by individual Providers
  • Clients should review the Provider's cancellation policy before booking
  • Disputes should first be resolved directly between Clients and Providers
  • Zuki may mediate disputes at our discretion

8. Intellectual Property

  • The Service and its original content, features, and functionality are owned by Zuki
  • You retain ownership of content you submit, but grant Zuki a license to use it for operating the Service
  • You may not copy, modify, or distribute any part of the Service without permission

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Disclaimers

Important Notice: The Service is provided "as is" without warranties of any kind. Zuki does not guarantee:

  • The quality, safety, or legality of services offered by Providers
  • The accuracy of information provided by users
  • Uninterrupted or error-free operation of the Service

Platform Limitation: Zuki is a platform that connects Providers and Clients. We are not responsible for the actions or omissions of any user.

11. Limitation of Liability

Liability Cap: To the maximum extent permitted by law, Zuki shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability shall not exceed the greater of: (a) the fees you paid to Zuki in the past 12 months, or (b) $100.

12. Indemnification

You agree to indemnify and hold harmless Zuki, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party

13. Termination

  • You may terminate your account at any time through the App settings
  • Zuki may suspend or terminate your account for violation of these Terms
  • Upon termination, your right to use the Service ceases immediately

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via:

  • Email (if you have provided one)
  • In-app notification
  • Notice on our website

Your continued use after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
